Time to take a look at recent bankruptcy news in Brooklyn.

Brooklyn Money Manager Indicted in 30-Year Ponzi Scheme (Wall Street Journal Online) – Bay Ridge, Brooklyn-based money manager Philip Barry–aka the “Brooklyn Madoff”–was charged with securities fraud and 20 counts of mail fraud earlier this week.

Star of Real Estate Boom is Confronting Hard Times (New York Times) – Shayla Boymelgreen is facing eviction from his Brooklyn headquarters and a possible bankruptcy filing for one of his real estate companies.  He also faces lawsuits from condo owners, foreclosure on a theater he owns in Queens and has reportedly reduced his staff from 200 to 15.  Compared to Robert Moses, he is responsible for over 2,400 apartments in NYC, including one condo in DUMBO where residents have apparently had to spend on repairs from their own pockets to connect the building’s waste line to the city’s waste line so the sewage didn’t flow into the street, among other things.

20 Bayard Condo Files for Chapter 11 (TheRealDeal.com) – The big fancy condo on 20 Bayard St in Brooklyn overlooking McCarren Park filed for bankruptcy on December 4.  Owned by North Development Group, it apparently owed $10 million to 50 parties.  The largest creditor claim was by contract Add Plumbing for $325,000.

How Can a Debtor (or Creditor) Get a New Trustee?

The trustee in a New York bankruptcy case is usually not the debtor’s ally. His or her purpose is mainly to administer the bankruptcy estate or ensure the debtor’s repayment plan goes according to plan. Trustees pursue preference payments, fraudulent conveyances, and other malfeasance committed by debtors. They frequently initiate adversary proceedings against debtors. In
