You’ve seen the commercials on tv and heard them on the radio.  Maybe seen billboards or ads on the subway or at the bus stops.  “We’ll fix your credit!” they tell you in a voice that sounds vaguely familiar to that voice that cries, “But wait!  There’s more!  For $19.95 you also get this handy-dandy, completely useless slicer-dicer….”<\/p>\n

Credit repair schemes are generally not to be trusted.  But to help you out, and with all due respect to Jeff Foxworthy, it might be a scam if:<\/p>\n

1.  You’re supposed to pay money up front to the credit repair service.  The Credit Repair Organizations Act<\/strong><\/a> makes it illegal for such services to charge fees in advance.  Of course, just because it’s illegal doesn’t mean that credit repair services won’t still try to get an up front fee.  So watch out.<\/p>\n

2.  Guarantees that they can remove all negative marks from your credit report.  They simply can’t guarantee this, so don’t believe the hype.  Actually, that’s not entirely true because after 7 to 10 years, credit reporting agencies are required to remove negative marks from your credit report anyway.  So if you pay money to a credit repair service, then your negative marks will eventually disappear.  But they’ll also of course disappear after 7 to 10 years if you do nothing.  In other words, don’t believe the hype.<\/p>\n

3.  They tell you to create a “new identity” in order to start a new credit history.  Doing this is clearly illegal and would likely land you in bigger trouble than what you’re already in.  Plus, you’re still responsible for the debts you owe regardless of your identity.  Please don’t dig yourself a deeper hole.<\/p>\n

The best and safest and most reliable option for dealing with bad credit and overwhelming debt problems in New York is always to speak with a trusted New York bankruptcy attorney.  A good New York bankruptcy attorney will be looking out for your interests.  If filing for bankruptcy is the best option, then they’ll guide you through it.  If there are other strategies available, then they’ll guide you down the appropriate path.<\/p>\n
