There are a couple helpful points in this cartoon. First, a nice and concise explanation of the 341 Meeting of Creditors. (For a little more explanation, see my recent post on the 341 Meeting of Creditors here.) Second, lawyers often do slip into jargon when explaining the bankruptcy process. If you’re working with a bankruptcy lawyer (or any lawyer), don’t be afraid to ask your lawyer to define his or her terms and provide an explanation that’s clear to an average person. Lastly, in case it’s not clear, to “file a bankruptcy petition” just means to file your bankruptcy case with the bankruptcy court. Needless to say, you don’t need to gather any signatures (other than your own). In fact, your bankruptcy petition is usually filed electronically by your bankruptcy lawyer these days, which means most cases can be filed in a matter of minutes.
